Terms and Conditions

1. Scope of Application

These General Terms and Conditions (GTC) govern the legal relationship between you as a customer, hereinafter referred to as the “Customer” and “Ordering Party,” and Hotel Hof Weissbad AG, hereinafter also referred to as the “Hotel,” regardless of whether the contract is concluded directly at the reception desk, via telephone, or through an online booking or order in the online shop.

Only the hotel’s terms and conditions valid at the time of contract conclusion apply. The guest’s general terms and conditions apply only if this was expressly agreed in writing prior to signing the contract.

2. Subject Matter of the Contract

The contract for the rental of rooms, seminar rooms, and spaces, as well as for the provision of other goods and services and online orders, is concluded upon the guest’s written confirmation or by implication. A reservation made on the day of arrival becomes binding upon acceptance by the hotel.

Contractual changes become binding for the hotel only upon (written) confirmation. Unilateral changes or additions to the contract by the guest are invalid. The subletting or re-letting of the rooms provided, as well as their use for purposes other than accommodation, require the prior written consent of the hotel

3. Scope of Services

The scope of services under the contract is determined by the guest’s individual reservation and confirmation. Unless otherwise agreed upon in the contract, the guest has no right to a specific room.

If, despite a confirmed reservation, no rooms are available at the hotel, the hotel must inform the guest in a timely manner and offer equivalent alternative accommodation at a nearby hotel. Any additional expenses for the alternative accommodation shall be borne by the hotel. If the guest declines the alternative room, the hotel must immediately refund any payments already made by the guest (e.g., deposits). The guest has no further claims.

4. Prices

All prices include the statutory value-added tax for Switzerland. Prices are subject to change and errors excepted.

5. Cancellation Policy

Cancellations are handled in accordance with Art. 160 of the Swiss Code of Obligations.

Cancellation Policy for Individual & Package Guests

Changes and Cancellations of Bookings:
The decisive factor for determining whether a cancellation or change to a booking was made in a timely manner is the receipt of the written notification by the central reservations department of Hof Weissbad AG (reservation@hofweissbad.ch), as well as the subsequent written confirmation from the Hof Weissbad reservations department.

Cancellations of online bookings:
Cancellations made via online booking systems are only legally valid if they are processed through the booking system in accordance with the cancellation policy and accepted by the hotel.

If the customer withdraws from the contract, the following cancellation fees apply depending on the type of booking:

November 1 through March 31 (excluding December 23 – January 2)

  • Up to 7 days before arrival: free of charge
    6–5 days prior to arrival: 50% of the total package price
    4–0 days prior to arrival: 100% of the total package price

April 1 through October 31 (including Dec. 23 – Jan. 2)

  • Up to 15 days before arrival: free of charge
    14–5 days prior to arrival: 50% of the total package price
    4–0 days prior to arrival: 100% of the total package price 
  • No-Show (Failure to Arrive): 100% of the total package price
  • In the event of a shortened stay or early departure without a medical reason, the full package price applies

Cancellation Policy for Spa Guests

Changes and Cancellations of Bookings:
The date of receipt of the written notification by the administration department of the Hof Weissbad AG Health Center (gz.administration@hofweissbad.ch) and the subsequent written confirmation from the Hof Weissbad AG Health Center are decisive for determining whether a cancellation or change to the booking was made in a timely manner.

If the customer withdraws from the contract, the following cancellation fees are payable:

  • Free of charge up to 7 days before arrival
  • 6–5 days prior to arrival: 50% of the total package price
    4–0 days prior to arrival: 100% of the total package price
  • No-Show (Failure to Arrive): 100% of the total package price
  • In the event of a shortened stay or early departure without a medical reason, the full package price applies

Cancellation Policy for Banquets (11 or more people)
Banquets: catering services only for restaurants, Hofhaus, and Blumenwerkstatt

In the event of cancellation of a definitively confirmed event, written notification must be sent to the Seminar & Banquet Department of Hof Weissbad AG (seminar@hofweissbad.ch), followed by written confirmation from the Seminar & Banquet Department of Hof Weissbad AG.

The following costs will be charged:

  • 10–6 days before the event: 30% of the confirmed menu price and the confirmed number of guests
  • 5–2 days before the event: 80% of the confirmed menu price and the confirmed number of guests
  • 1–0 days before the event: 100% of the confirmed menu price and the confirmed number of guests

In the event of a cancellation for the entire group, a processing fee of CHF 250 will be added to the event costs. Our General Terms and Conditions apply to the cancellation of hotel rooms (groups of 11 or more people).

Cancellation Policy for Groups (11 or more people) and Seminars
Groups: Accommodation and Dining/Seminars

If the group/event is canceled or reduced for reasons attributable to the organizer, the organizer undertakes to cover the following costs.

The date of receipt of the written notification by the Seminar & Banquet Department of Hof Weissbad AG (seminar@hofweissbad.ch) and the subsequent written confirmation from the Seminar & Banquet Department of Hof Weissbad AG are decisive for determining whether a cancellation or change to the booking was made in a timely manner.

  • Free of charge up to 30 days before arrival
  • 29–15 days: 50% of the total price
  • 14–8 days: 60% of the total price
  • 7–4 days: 80% of the total price
  • 3–0 days: 100% of the total price

Cancellations made after the free cancellation period, no-shows, and early departures will be charged at 100% of the booked stay.

6. Cancellation by Hotel Hof Weissbad

Up to and including 7 days prior to the guests’ agreed arrival date, the hotel may withdraw from the contract without incurring any costs. Furthermore, the hotel is entitled to withdraw from the contract extraordinarily and with immediate effect at any time for objectively justified reasons by means of an immediate unilateral written declaration.

Objectively justified reasons include, for example:

  • an agreed advance payment or security deposit is not made within the period set by the hotel;
  • force majeure or other circumstances beyond the hotel’s control that make the fulfillment of the contract objectively impossible;
  • Rooms or spaces that are booked or used based on misleading or false information, e.g., regarding the guest’s identity or the purpose of use or stay;
  • the hotel has reasonable grounds to believe that the use of the agreed services may interfere with the smooth operation of the business, the safety of other hotel guests, or the reputation of the hotel;
  • the guest has become insolvent (bankruptcy or unsuccessful garnishment) or has suspended payments;
  • the purpose or reason for the stay is unlawful.

In the event of cancellation by Hotel Hof Weissbad for the aforementioned reasons, the guest shall have no claim for damages, and payment for the booked services shall remain due in principle.

7. Privacy and Data Security

The Hotel Hof Weissbad undertakes to comply with the general provisions of data protection and data security. The data entered by customers is treated as strictly confidential and will not be disclosed to third parties.

8. Online Store

Registration

Registration at www.hofweissbad.ch is reserved exclusively for persons with full legal capacity. By placing an order, the customer warrants that he or she is at least 18 years old, not legally incapacitated, and of sound mind. There is no entitlement to admission to the online shop. The customer must provide the data required for registration completely and truthfully. The customer is personally responsible for updating his or her data.

Order/Conclusion of Contract

The order is only binding once it has been confirmed by email from Hotel Hof Weissbad. Hotel Hof Weissbad reserves the right not to confirm an order without providing a reason. By placing an order, the customer confirms the accuracy of all information provided. If the customer’s information is incorrect or incomplete, the hotel may withdraw from the contract.

Delivery

Ordered goods are handed over to the postal service as quickly as possible, usually on the same day. If individual items are not in stock, the shipping date may be delayed depending on the manufacturer’s delivery times. Delivery times are always non-binding, and delivery delays do not in any case justify claims for damages or the customer’s right to withdraw from the contract.

The customer is obligated to inspect the delivery immediately upon receipt and to return incorrect or defective deliveries within 14 days. All products not returned for these reasons will be billed. Hof Weissbad delivers exclusively to the geographical area of Switzerland and Liechtenstein.

Payment

Payment by the customer can be made via PayPal, credit card (Mastercard and Visa), Postcard, prepayment, TWINT, or by invoice. The payment process is always conducted using secure SSL encryption technology.

The goods remain the property of Hotel Hof Weissbad until the invoice amount has been paid in full.

Right of Return / Notice of Defects

We grant a right of return for purchased products. The goods must be returned in unused, like-new condition within 14 days of receipt in their original packaging.

Defects must be reported in writing within 14 days of receipt of the goods. Otherwise, the goods are deemed to be in perfect condition and accepted by the customer.

Damage incurred during transport must be reported within 5 days via email to both Swiss Post and Hotel Hof Weissbad. The customer bears the risk of transport damage unless they can transfer this risk to the carrier.

Liability

To the extent permitted by law, Hotel Hof Weissbad excludes any liability toward the customer for any damages or consequential damages (e.g., resulting from accidents and/or injuries sustained in connection with the products we sell). Under no circumstances shall breach of contract, impossibility of performance, fault at the time of contract conclusion, or tort give rise to claims for damages or a right to withdraw from the contract.

9. Place of Jurisdiction and Applicable Law

Our business activities and, consequently, the relationship between the customer and Hotel Hof Weissbad are governed exclusively by Swiss law. For any disputes arising from this contract, Appenzell AI shall be the place of enforcement and the exclusive venue for all proceedings.

10. Final Provisions

Should any individual provisions of these Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.

The Hotel Hof Weissbad reserves the right to change the Terms and Conditions at any time.
