Our employees are obligated to treat personal data confidentially.

Scope and Purpose of the Collection, Processing, and Use of Personal Data
What personal data we collect
We may collect master data (e.g., company name, name, address, email address, etc.), personal data regarding the services you have purchased, your payment details, your online preferences, and your customer feedback. We use this personal data to communicate with you, to conclude and process transactions with you, to operate the technology, for billing, market research, and marketing—for example, to analyze our customer base or to contact you by mail, email, or text message.

We may collect personal data regarding your creditworthiness to protect ourselves against payment defaults.
Your browsing and usage data will then be collected. This includes, for example, your IP address, information about the device, browser, and browser version you used to visit the technology, when you visited it, which operating system you use, from which website or app you accessed our technology via a link, and which elements of the technology you use and how. This personal data is stored together with the IP address of your access device. It is used to display our technology correctly, optimize it, protect it from attacks or other legal violations, and personalize the technology for you.

When visiting www.hofweissbad.ch
When you visit our website, our servers temporarily store each visit in a log file. The following user and device data, as well as personal data, are collected automatically and stored by our host (ISP – Internet Service Provider):

  • the IP address of the requesting computer
  • Date and time of access
  • Name and URL of the accessed file
  • the website from which the access occurred
  • your computer’s operating system and the browser you are using
  • the country from which you accessed the website, and your browser’s language settings

This data is collected and processed for the purpose of enabling the use of our website (establishing a connection), ensuring long-term system security and stability, optimizing our website, and for internal statistical purposes. This constitutes our legitimate interest in data processing. The IP address is used in particular to determine the country of residence of the website visitor. In addition, the IP address is used in the event of attacks on the network infrastructure of www.hofweissbad.ch, evaluated for statistical purposes. In addition, when you visit our website, we use so-called pixels and cookies to display personalized advertising and utilize web analytics services.

Use of Your Data for Advertising Purposes
Creation of pseudonymized user profiles
To enable personalized marketing on social networks, we use so-called remarketing pixels on our technology. If you have an account with one of the social networks listed there and are logged in at the time of your visit to the website, this pixel links your visit to the website with your account. You can adjust further advertising settings in your user profile on the respective social networks. We use retargeting technologies. This involves analyzing your user behavior on our platform in order to subsequently offer you advertising tailored to your individual interests on partner websites. Your user behavior is recorded in pseudonymized form. Most retargeting technologies use cookies. You can prevent retargeting at any time by rejecting or disabling the relevant cookies in your web browser’s menu bar. You can also do this via the Digital Advertising Alliance website at optout.aboutads.info Request an opt-out for the additional advertising and retargeting tools mentioned above.

The following remarketing pixels are used on the site:
Google Tag Manager
We also use Google Tag Manager to manage services for usage-based advertising. The Tag Manager tool itself is a cookie-free domain and does not collect any personal data. Rather, the tool triggers other tags that may collect data (see above). If you have disabled cookies at the domain or cookie level, this setting remains effective for all tracking tags implemented with Google Tag Manager.
AdWords and DoubleClick
We use Google AdWords Remarketing and DoubleClick by Google, services provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”), to display ads based on your use of previously visited websites. To do this, Google uses the so-called DoubleClick cookie, which allows your browser to be recognized when you visit other websites. The information generated by the cookie regarding your use of this technology (including your IP address) is transmitted to a Google server in the United States and stored there (for information on the transfer of personal data to the United States, see “Transfer of Personal Data Abroad” below). Google will use this information to evaluate your use of the website with regard to the ads to be displayed, to compile reports on website activity and ad performance for website operators, and to provide other services related to website activity and internet usage. Google may also transfer this information to third parties where required by law or where such third parties process the data on Google’s behalf. Google will under no circumstances associate your IP address with any other data held by Google.

Disclosure of Data to Third Parties
We share your personal data if you have expressly consented to it, if there is a legal obligation to do so, or if it is necessary to enforce our rights, in particular to enforce claims arising from the relationship between you and Hotel Hof Weissbad (e.g., collection agencies, authorities, or lawyers). We share your data with third parties to the extent necessary in connection with the use of technology to provide the services you have requested (e.g., outsourcing partners, hosting providers, companies with which we offer services using our technology (e.g., for bookings, rentals, purchases, etc.), companies that advertise on our behalf), and the analysis of your user behavior.
When disclosing data to third parties, we ensure that sufficient contractual safeguards are in place to guarantee that these third parties use the personal data in accordance with legal requirements and exclusively in our interest.
If the technology contains links to third-party websites, Hotel Hof Weissbad has no influence over the collection, processing, storage, or use of personal data by the third party after clicking these links and assumes no responsibility for this.

Data Processor
We use external service providers (processors), e.g., for shipping goods, newsletters, online bookings, gift certificates, or payment processing. A separate data processing agreement has been concluded with the service provider to ensure the protection of your personal data. We work with the following service providers:

  • HotelNetSolutions GmbH, Genthiner Straße 8, DE-10785 Berlin (Online booking CBooking) www.hotelnetsolutions.de
  • Idea Creation GmbH, Walchestrasse 15, CH-8006 Zurich (E-GUMA Voucher Tool), www.e-guma.ch
  • Hostpoint AG, Neue Jonastrasse 60, CH-8640 Rapperswil-Jona, www.hostpoint.ch
  • MailChimp, The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308 USA

Transfer of personal data abroad
The Hotel Hof Weissbad is authorized to transfer your personal data to third-party companies (contracted service providers) abroad, provided this is necessary for the data processing described in this privacy policy. These companies are subject to the same data protection obligations as we are. If the level of data protection in a country does not correspond to that in Switzerland or the EU, we ensure through contractual agreements that the protection of your personal data at all times corresponds to that in Switzerland or the EU.
For the sake of completeness, we would like to inform users residing or headquartered in Switzerland that surveillance measures exist in the United States that generally allow for the storage of all personal data of all individuals whose data has been transferred from Switzerland to the United States. This occurs without differentiation, restriction, or exception based on the intended purpose and without an objective criterion that would limit the U.S. authorities’ access to the data and its subsequent use to specific, precisely defined purposes that would justify the intrusion associated with accessing and using this data. We also note that there are no legal remedies in the United States for data subjects from Switzerland that would allow them to access the data concerning them and have it corrected or deleted, and that there is also no effective judicial protection against the general access rights of U.S. authorities. We expressly inform data subjects of this legal and factual situation so that they can make an informed decision regarding consent to the use of their data. We would like to inform users residing in an EU member state that, from the European Union’s perspective, the United States does not provide an adequate level of data protection, among other reasons due to the issues mentioned in this section. Since we have explained in this Privacy Policy that the recipients of the data (such as Google, Facebook, or LinkedIn) are based in the United States, we will ensure that your data is protected to an adequate level by our partners, either through contractual agreements with these companies or by ensuring that these companies are certified under the EU-U.S. Privacy Shield.

Data
We implement appropriate technical and organizational security measures to protect your personal data stored with us against manipulation, partial or complete loss, and unauthorized access by third parties. Our security measures are continuously improved in line with technological developments. You should always treat your data confidentially and close the browser window when you have finished communicating with us, especially if you share your computer with others. We also take internal data protection very seriously. Our employees and the service providers we engage are obligated to maintain confidentiality and comply with data protection regulations.

Cookies
We use cookies in our technology. Cookies help in many ways to make your visit to our website easier, more enjoyable, and more meaningful. Cookies are information files that your web browser automatically stores on your computer’s hard drive when you visit our website.
Session cookies are used to assign information stored on the server to you or your web browser during a specific visit to our website (e.g., in the online shop) so that you can be uniquely identified during each visit (e.g., so that the contents of your shopping cart are not lost). Session cookies are deleted when you close your web browser. Persistent cookies are used to save your preferences (e.g., preferred language) across multiple independent visits to our website, i.e., even after you have closed your web browser, or to enable automatic login. Persistent cookies are deleted only in accordance with your web browser settings (e.g., one month after your last visit). By using our website and its features (e.g., language selection or automatic login), you consent to the use of persistent cookies.
Cookies do not cause any damage to your computer’s hard drive and do not transmit any personal data about you to us. We use cookies, for example, to better tailor the information, offers, and advertisements displayed to you to your individual interests. Their use does not provide us with any new personal data about you as an online visitor. Most internet browsers automatically accept cookies. However, you can configure your browser so that no cookies are stored on your computer or so that a message always appears when you receive a new cookie. Disabling cookies may prevent you from using all the features of our website.

We use the consent tool “Real Cookie Banner” to manage the cookies and similar technologies (tracking pixels, web beacons, etc.) used, as well as the associated consents. Details on how “Real Cookie Banner” works can be found at https://devowl.io/de/rcb/datenverarbeitung

Tracking Tools
We use tracking tools on our website. These tracking tools monitor your browsing behavior on our website. This monitoring is carried out for the purpose of designing our website to meet your needs and for its ongoing optimization. In this context, pseudonymized usage profiles are created and small text files are stored on your computer (“cookies”).
Third-party providers may also use persistent cookies, pixel tags, or similar technologies for this purpose. The third-party provider does not receive any personal data from us, but may track your use of our website, combine this information with data from other websites you have visited that are also tracked by the third-party provider, and use this information for its own purposes (e.g., to manage advertising). The processing of your personal data by the third-party provider is then carried out under the responsibility of the service provider in accordance with its privacy policy.
The following tracking tools are used:

Social Media Plugins
This website uses the social plugins described below. The plugins are disabled by default on our website whenever possible and therefore do not send any data. You can enable the plugins by clicking on the corresponding social media button. When these plugins are enabled, your browser establishes a direct connection to the servers of the respective social network as soon as you visit one of our web pages. The plugin’s content is transmitted directly from the social network to your browser and integrated into the website. The plugins can be deactivated again with a single click.

Google
On certain pages, you will find maps integrated from Google Maps. Google Maps is a product of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The maps are displayed using an iFrame. This means that this section of the website accesses a third-party website. We have no influence over data processing within this iFrame. Google associates the access with your Google account. Google Maps sets a cookie as soon as the page loads. If you wish to prevent this, you can disable Google cookies for your browser via the links provided under “Opt-out/Opt-in Options.”

Facebook Social Plugins
This website uses Facebook social plugins to personalize our website. For this purpose, we use the “LIKE” or “SHARE” button. This is a service provided by the U.S. company Facebook Headquarters, 1 Hacker Way, Menlo Park, California 94025 USA, Phone: 1-650-308-7300. By integrating the plugins, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted directly from your browser to a Facebook server in the U.S. and stored there. If you are logged in to Facebook, Facebook can directly associate your visit to our website with your Facebook account. If you interact with the plugins, for example by clicking the “LIKE” or “SHARE” button, the corresponding information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and displayed to your Facebook friends. For this purpose, Facebook creates usage, interest, and relationship profiles to, for example, evaluate your use of our website in relation to the advertisements displayed to you on Facebook, inform other Facebook users about your activities on our website, and provide other services associated with the use of Facebook. For information on the purpose and scope of data collection, as well as the further processing and use of the data by Facebook, and your rights and settings options regarding the protection of your privacy, please refer to Facebook’s privacy policy.

YouTube
On certain pages, you will find videos embedded from YouTube. YouTube is a product of YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA, a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The videos are displayed using an iFrame. This means that when you watch the video, you are accessing a third-party website. We have no influence over the data processing that takes place within this iFrame. If you are logged into your YouTube account, YouTube will associate the video you are watching with your YouTube account. If you wish to prevent this, please log out of your YouTube account. YouTube sets a cookie as soon as the page loads. If you wish to prevent this, you can use the links provided under “Opt-out/Opt-in Options” to disable Google.
Disable cookies for your browser.

Analysis of Newsletter Usage
We use third-party email marketing services to send our newsletter. Our newsletter may therefore contain a so-called web beacon (tracking pixel) or similar technical means. A web beacon is an invisible graphic measuring 1×1 pixel that is linked to the user ID of the respective newsletter subscriber. This pixel is only activated when you view the images in the newsletter. By using such services, we can determine whether the emails containing our newsletter have been opened. Additionally, the clicking behavior of newsletter recipients can also be recorded and analyzed. We use this data for statistical purposes and to optimize the newsletter in terms of content and structure. This allows us to better tailor the information and offers in our newsletter to the interests of our readers. The tracking pixel is deleted when you delete the newsletter. To prevent tracking pixels in our newsletter, please configure your email program so that HTML is not displayed in messages.

Automated Decision-Making / Profiling
We (or third parties commissioned by us) do not make automated decisions that affect your personal data, have legal implications for you, or similarly significantly affect you.

Legal basis for processing
The legal basis for our processing of personal data is generally found in Article 13(2)(a) of the DSG (processing directly related to the conclusion or performance of a contract; corresponds to Art. 6(1)(b) of the EU GDPR) and in § 13(1) of the DSG (consent of the data subject or legal obligation to process; corresponds to Art. 6(1)(a) EU GDPR). In the event that we wish to refuse future contract conclusion with data subjects due to misuse, late payment, or similar legitimate reasons, we reserve the right, based on § 13(1) DSG (corresponds to Art. 6(1)(f) EU GDPR), to store the last name, first name, address, and email address of a data subject, as well as the personal data related to the respective circumstances, in our own interest. Your personal data is also processed by other group companies in accordance with Art. 13(1) DSG (corresponds to Art. 6(1)(f) EU GDPR).

Your Rights
Upon request, we will inform each data subject whether and which personal data is being processed about them (right to confirmation, right to access). At your request:

  • We refrain from processing personal data in whole or in part (right to withdraw your consent to the processing of non-essential personal data; right to be forgotten). We will also inform third parties to whom we have previously forwarded your personal data of your request to be forgotten.
  • We will correct the relevant personal data (right to rectification).
  • We restrict the processing of the relevant personal data (right to restriction of processing; in this case, we will only store or use your personal data to protect our legal claims or the rights of another person).
  • You will receive the relevant personal data in a structured, commonly used, and machine-readable format (right to data portability).

To exercise a right described in this section, for example, if you no longer wish to receive email newsletters from us or wish to delete your account, please use the corresponding function on our website or contact our Data Protection Officer or a member of staff, as indicated at the beginning of this Privacy Policy. If we do not comply with a request, we will inform you of the reasons why. For example, we may refuse to delete your personal data in a manner permitted by law if your personal data is still required for the original purposes (e.g., if you are still receiving a service from us), if the processing is based on a compelling legal basis (e.g., statutory accounting obligations), or if we have an overriding interest (e.g., in the event of a legal dispute with the data subject). If we assert an overriding interest in processing personal data, you still have the right to object to the processing if your particular situation outweighs our interests (right to object). This could be the case, for example, if you are a public figure or if the processing carries the risk that you may be harmed by third parties. If you are not satisfied with our response to your request, you have the right to file a complaint with a competent supervisory authority, for example in your country of residence or at the registered office of Hotel Hof Weissbad (right to lodge a complaint).

Data Storage
We process personal data only for as long as is necessary for the respective purpose or required by law. If you have created an account with us, we store the master data provided for this purpose indefinitely. However, you may request the deletion of your account at any time (see the “Your Rights” section). We delete the master data unless we are legally required to retain it. If you place an order without an account, your master data will be deleted after the warranty period expires or after the service is completed, unless we are legally required to retain it. This deletion may occur immediately or as part of regular deletion cycles.
Contract data, which may also contain personal data, is stored by us until the expiration of the statutory retention period of 10 years. Retention obligations arise, among other things, from accounting and tax law regulations as well as from the obligation to retain electronic communications. If we no longer need this data to provide services to you, the data will be blocked. This means that the data may then only be used for accounting and tax purposes.
If we wish to refuse further business transactions with a data subject due to misuse, non-payment, or other legitimate reasons, we will store the relevant personal data for five years; in the case of repeat offenses, for ten years.

Opt-out/Opt-in Option
If you do not consent to the analysis of your usage data, you can disable it. Tracking is disabled by setting a so-called “opt-out cookie” on your system. If you delete all your cookies, please note that the opt-out cookie will also be lost and may need to be reset.
Please note that the following list is a list of opt-out options, which sometimes also includes trackers from our partners that are not necessarily used on the website:

A good way to configure a large number of cookies can be found at youronlinechoices.com or at optout.aboutads.info
