General Terms and Conditions

1. Scope of application

These General Terms and Conditions (GTC) govern the legal relationship between you as a customer, hereinafter referred to as the customer or orderer, and Hotel Hof Weissbad AG, hereinafter also referred to as the hotel, irrespective of whether the contract is concluded directly at reception, by telephone, online booking or online order in the online shop.

The terms and conditions of the hotel valid at the time of conclusion of the contract shall apply exclusively. The guest’s general terms and conditions shall only apply if this has been expressly agreed in writing before the contract is signed.

2. Subject matter of the contract

The contract for the rental of rooms, seminar rooms, areas and the purchase of other goods and services as well as online orders is concluded with the written confirmation of the guest or by implication. A reservation made on the day of arrival itself is binding at the moment of acceptance by the hotel.

Amendments to the contract shall only become binding for the hotel upon (written) confirmation. Unilateral amendments or additions to the contract by the guest are invalid. The subletting and re-letting of the rooms provided and their use for purposes other than accommodation require the prior written consent of the hotel.

3. Scope of services

The scope of the contract is determined by the individual reservation made and confirmed by the guest. Subject to other contractual agreements, the guest is not entitled to a specific room.

If, despite a confirmed reservation, no rooms are available in the hotel, the hotel must inform the guest in good time and offer an equivalent replacement in a nearby hotel. Any additional expenses for the alternative accommodation shall be borne by the hotel. If the guest refuses the replacement room, the hotel must immediately refund any payments already made by the guest (e.g. deposits). The guest shall have no further claims.

4. Prices

All prices include the statutory value added tax for Switzerland. Prices are subject to change and errors excepted.

5. Cancellation provisions

Cancellations are handled in accordance with Art. 160 of the Swiss Code of Obligations. Cancellations must generally be made in writing.

Cancellation is free of charge up to 7 days before arrival.

Cancellations made less than 7 days before arrival and shortening of the booked stay will be charged at the full package price.

6. early departure

Early departure and/or late arrival will be treated as a “no show” (no-show of the guest) and will be charged unless the reservation is changed in writing 7 days in advance. We recommend that you take out cancellation insurance.

7. Cancellation by the Hotel Hof Weissbad

Up to and including 7 days before the agreed date of arrival of the guests, the hotel may withdraw from the contract without incurring any costs. Furthermore, the hotel is entitled to withdraw from the contract at any time for objectively justified reasons by means of an immediate unilateral and written declaration with immediate effect.

Objectively justified reasons include, for example

  • an agreed advance payment or security deposit is not made during the period set by the hotel;
  • force majeure or other circumstances for which the hotel is not responsible and which make fulfilment of the contract objectively impossible;
  • rooms or spaces are booked or used with misleading or false information, e.g. regarding the person of the guest or the purpose of use or stay;
  • the hotel has reasonable grounds to believe that the utilisation of the agreed services may impair the smooth running of the business, the safety of other hotel guests or the reputation of the hotel;
  • the guest has become insolvent (bankruptcy or unsuccessful seizure) or has stopped making payments;
  • the purpose or reason for the stay is illegal.

In the event of cancellation by the Hotel Hof Weissbad for the aforementioned reasons, the guest shall not be entitled to any compensation and the compensation for the booked services shall remain due.

8. Data protection and data security

The Hotel Hof Weissbad undertakes to comply with the general provisions of data protection and data security. The data entered by customers will be treated as strictly confidential and will not be passed on to third parties.

9. Online shop


Registration at is reserved exclusively for persons with full legal capacity. By placing an order, the customer guarantees that he or she is at least 18 years old, not incapacitated and capable of judgement. There is no entitlement to admission to the online shop. The data required for registration must be provided by the customer completely and truthfully. The customer is responsible for updating their own data.

Order/conclusion of contract

The order is only binding once it has been confirmed by the Hotel Hof Weissbad by e-mail. Hof Weissbad is free not to confirm an order without giving reasons. By placing an order, the customer confirms the accuracy of all information provided. If the customer’s details are incorrect or incomplete, the hotel may withdraw from the contract.


Ordered goods are handed over to the post office as quickly as possible, usually on the same day. If individual items are not in stock, the time of despatch may be delayed depending on the manufacturer’s delivery times. Delivery times are always non-binding and delays in delivery do not justify claims for damages or the possibility of cancellation of the contract by the customer.

The customer is obliged to check the delivery immediately upon receipt and to return incorrect or defective deliveries within 14 days. All products not returned for these reasons will be invoiced. Hof Weissbad delivers exclusively to the geographical area of Switzerland and Liechtenstein.


The customer can pay by PayPal, credit card (MasterCard and Visa Card), Postcard, prepayment, TWINT or by invoice. In all cases, the payment process is carried out using secure SSL encryption technology.

The goods remain the property of Hotel Hof Weissbad until the invoice amount has been paid in full.

Right of return / notification of defects

We grant a right of return on the products purchased. The goods must be returned in unused, as-new condition within 14 days of receipt in the original packaging.

Defects must be reported in writing within 14 days of receipt of the goods. Otherwise the goods shall be deemed to be in perfect condition and accepted by the customer.

Transport damage must be reported within 5 days both to Swiss Post and to Hotel Hof Weissbad by e-mail. The customer bears the risk of transport damage unless he can pass this on to the carrier.


To the extent permitted by law, the Hotel Hof Weissbad excludes all liability to the customer for damage and consequential damage (e.g. as a result of accidents and/or injuries sustained for the products we sell). Under no circumstances shall breach of contract, impossibility of performance, culpa in contrahendo or unauthorised action give rise to claims for damages or a right to withdraw from the contract.

10. Place of jurisdiction and applicable law

Our business activities and thus the relationship between the customer and the Hotel Hof Weissbad are based exclusively on Swiss law. For any disputes arising from this contract, Appenzell AI shall be the place of debt collection and the exclusive place of jurisdiction for all proceedings.

11. Final provisions

Should individual points of these GTC be invalid, this shall not affect the validity of the remaining provisions.

The Hotel Hof Weissbad reserves the right to amend the GTC at any time.
